Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tristate Date (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You must not be barred from using the Service under applicable law and must not be a registered sex offender. By using the Service you represent and warrant that you meet these requirements.

2. Your Account

You are responsible for activity on your account, the accuracy of the information you provide, and keeping your credentials secure. You agree to provide truthful information and not to impersonate any person or misrepresent your identity, age, affiliation, or location.

3. Acceptable Use

You agree not to: (a) harass, threaten, defraud, or stalk any user; (b) post content that is unlawful, obscene, sexually explicit involving minors, defamatory, infringing, or hateful; (c) solicit money, send spam, or promote commercial activity; (d) collect or scrape user data; (e) attempt to circumvent safety features; or (f) use the Service for any unlawful purpose. We may remove content and suspend or terminate accounts at our sole discretion.

4. User Content

You retain ownership of content you post but grant Tristate Date a worldwide, royalty-free, sublicensable license to host, store, display, and distribute that content for the purpose of operating and improving the Service. You represent that you have the rights necessary to grant this license.

5. No Background Checks

We do not conduct criminal background or identity-verification checks on users. We make no representation that any user is who they claim to be. You are solely responsible for your interactions with other users. Always use caution, especially when meeting in person.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee matches, messages, relationships, or any specific results. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRISTATE DATE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.

8. Indemnification

You agree to indemnify and hold harmless Tristate Date, its officers, directors, employees, and agents from any claim, damages, liability, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law or rights of any third party.

9. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time from your profile.

10. Dispute Resolution; Arbitration; Class Waiver

You and Tristate Date agree to resolve any dispute arising out of or relating to these Terms or the Service by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, except that either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims, and either party may bring an individual action in small-claims court. YOU AND TRISTATE DATE WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. You may opt out of this arbitration agreement by emailing legal@tristatedate.app within 30 days of first accepting these Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Subject to Section 10, the exclusive venue for any permitted court action is the state and federal courts located in New York County, New York.

12. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
